Il concetto stesso di sport è un concetto dinamico, esattamente come accade con il diritto.
Alle Olimpiadi di Parigi del 1900, ci furono gare di mongolfiera, di tiro al piccione e di rope climbing.
Con il tempo, poi, queste discipline sono uscite dal programma olimpico e in alcuni casi hanno smesso persino di essere praticate. Allo stesso modo, esistono discipline che tempo fa non potevano essere immaginate e che sono divenute possibili solo con l'avvento di nuove tecnologie. Chi può dire se queste non saranno, un giorno, considerate sport?
Il presente lavoro è frutto di un lavoro collettivo della Commissione eSports dell'Associazione Italiana Avvocati dello Sport e costituisce il primo importante passo concreto verso lo studio di un fenomeno sociale che in futuro occuperà sempre più spazio nelle nostre vite.
Cosa sono gli sport elettronici, o meglio, cosa non sono? In cosa si differenziano dal gaming? L'incertezza nella regolamentazione può costituire un limite negli investimenti da parte dei terzi? Questi costituiscono solo alcuni dei quesiti che verranno esaminati in questo primo lavoro e che non esauriscono affatto la complessità del fenomeno che abbiamo scelto di studiare e che sarà oggetto di futuri approfondimenti.
